AFISCLEAR offers the expungement of criminal records. If a person qualifies for expungement, we can assist in having the record removed. This means that the record will be expunged from the Criminal Record Centre and resulting in a clear name when criminal record searches are done.
The criteria for expungement are as follow:
1. The conviction must be older than 10 years.
2. The offence must have been of a minor offence or a politically motivated crime.
3. The applicant must have either paid a fine (fine paid must not exceed R20 000.00), received a suspended sentence or have been sentenced to community service.
4. The conviction must not have resulted in mandatory jail time (this does not include time spent following initial arrest and time spent awaiting trial).
